NASHVILLE, Tenn. (WSMV) - A WSMV4 investigation has uncovered just how many Tennesseans have been charged with DUI who were completely sober at the time.

It’s the latest bombshell discovery in WSMV4’s “Sobering Problem” investigation.

One by one, WSMV shared their stories. Mothers who lost temporary custody of their children, fathers who lost jobs and insurance. Case after case of sober drivers charged with DUI.

WSMV4 Investigates has now uncovered how often it was happening.

Following the Sobering Problems investigation, the Tennessee Bureau of Investigation compiled all of the cases of people charged with DUI in a seven-year period who had no alcohol or drugs in their system.

This process revealed that it had happened to more than 600 Tennesseans. The number of Tennessee drivers charged with DUI while completely sober amounted to 609.

For perspective, if all the sober drivers charged with DUI went to the Ryman, they would take up more than half of the seats in the balcony.

WSMV4 Investigates has now uncovered how often sober drivers were getting arrested for DUI.

WSMV4 shared these findings with Xavier Gray, the latest Tennessean found by the WSMV 4 Investigates team arrested for DUI whose bloodwork shows he was completely sober at the time.

“It’s a miscarriage of justice,” Gray said. “I knew nothing was in my system. I thought I was a special situation, but it looks like I’m not.”

The first part of the data was gathered at the request of state Representative Lowell Russell, who watched WSMV4’s Sobering Problems investigations.

Russell said one of his constituents was arrested for DUI and was also sober at the time.

The data doesn‘t even include how often it’s happened in 2024. Gray’s arrest happened this year.

Even mothers against drunk driving calls these cases “tragic.”
