The lawsuit claims that the “Five-Year Rule“ and the ”Eligibility Clock” within the NCAA’s bylaws restrains the ability of those athletes to earn money through NILs.

NASHVILLE, Tenn. (WSMV) - The star quarterback at Vanderbilt University is suing the National Collegiate Athletic Association.

Diego Pavia is claiming that the association’s “JUCO Eligibility Limitation Bylaws” reduce the number of years that former junior college football players can play in Division I sports after transferring to an NCAA Division I school.

The lawsuit also claims that the “Five-Year Rule“ and the ”Eligibility Clock” within the bylaws restrains the ability of those athletes to earn money through the use of their name, image, and likeness (NIL).

The lawsuit calls for the NCAA to give Pavia a two more seasons of NCAA Division I competition and eligibility for the 2025-2026 and 2026-2027 seasons.

Pavia previously played two seasons at New Mexico Military Institute, a junior college, and two seasons at New Mexico State before eventually transferring to Vanderbilt.

This lawsuit said, “Pavia brings this action to put a stop to the unjustified, anticompetitive restriction on universities who seek to compete for college athletes, and to restore freedom of economic opportunity for himself and other college football players.”

The lawsuit calls for the NCAA to give Pavia a two more seasons of NCAA Division I competition and eligibility for the 2025-2026 and 2026-2027 seasons.
