Vanderbilt QB denied temporary restraining order against NCAA
Pavia previously played two seasons at New Mexico Military Institute, a junior college, and two seasons at New Mexico State before eventually transferring to Vanderbilt.
NASHVILLE, Tenn. (WSMV) - A Middle Tennessee judge has denied Vanderbilt star quarterback Diego Pavia’s request for a temporary restraining order against the NCAA.
Last week, before the Commodores’ loss to South Carolina, Pavia filed a lawsuit requesting the temporary restraining order arguing against the NCAA’s eligibility rules that prevent him from playing college football in the 2025-26 season.
The quarterback behind Vandy’s successful season thus far argued that the NCAA’s bylaws regarding a redshirt rule involving junior college eligibility (which he also claims forced him and other athletes to lose out on NIL money) violates the antitrust law.

At the time of the suit, he pushed for the temporary restraining order due to the urgency behind potential NIL contracts for the 2025 season and that collectives would move on to other athletes.
“Given that Plaintiff has almost certainly been aware of the challenged bylaws and his ineligibility to play college football in the 2025-26 season for quite some time and has been discussing possible resolution with the NCAA, the Court is not persuaded that an ex parte order is justified,” Judge Campbell wrote in his Tuesday ruling. “The Court is prepared to set an expedited briefing schedule and hearing on the request for preliminary injunction, but will first give the parties an opportunity to propose a schedule. After counsel for Defendant enters an appearance, the Court is also amenable to holding a telephone status conference should the parties so request.”
